ARTICLE 1 

Any reservation made with GROOM EPERNAY VTC entails the unconditional acceptance of these general conditions of sale.

ARTICLE 2 – RESERVATIONS

All services must be the subject of a reservation confirmed in writing. Reservations can be made on our dedicated page for this purpose www.groomepernay-vtc.com, by telephone on 06.03.31.27.15 or directly by email at the address: contact@groomepernay.com. An email confirming our availability will then be sent by our services. All reservations for services must be made no later than 24 hours before the start of the service, unless exceptional agreement has been reached by GROOM EPERNAY VTC. It must be carried out by the client or by a duly authorized agent. Any reservation must imperatively mention the following elements: name and contact details of the customer (address, email, telephone), address of the pick-up location and address of the arrival location for transfers, the desired duration for the provision, date and time of start of the service, number of passengers, number of pieces of luggage and size of luggage. A confirmation of reservation must be returned to us, by email or by post, marked "Good for agreement", and signed by the client.

ARTICLE 3 – SERVICES

The service is only valid once. The service begins at the vehicle's parking place, on the day and time fixed in the contract previously drawn up between the parties. It ends on the day and at the time fixed in the contract previously established between the parties.

 

In the event of a delay: a customer who does not notify of his delay, the driver will wait 15 minutes at the place of pick-up. The customer agrees to inform the driver by any means available of his delay before the initial start of the service and agrees to be billed for the waiting time if the delay is more than 15 minutes.

 

After this deadline GROOM EPERNAY VTC will consider the canceled service. This will be invoiced to the customer and will not give rise to any refund. If it turns out that the client is not present at the meeting place, the service will be definitively lost, due by it and will not give any right to reimbursement.

If the customer cannot find the driver, he must immediately call GROOM EPERNAY VTC to avoid being billed for the full amount of the service. Respect and proper use of equipment is essential. Any deterioration of the equipment and any damage caused inside the vehicle will be charged to the customer and will be invoiced to him. Smoking is strictly prohibited inside the vehicle. It is compulsory to wear a seat belt at the front and at the rear of the vehicle. Animals are not allowed in vehicles, except in a cage or bag provided for this purpose.

GROOM EPERNAY VTC is in no way responsible for items left in vehicles or elsewhere during the service. In any case, the customer may not require the driver to exceed the authorized speed limit or commit any traffic violation. More generally, the driver reserves the right to refuse any instructions and / or requests from the customer that he would consider to be of a nature to jeopardize the safety of the occupants of the vehicle and other road users. Our drivers are real professionals, their responsibility being engaged, they are instructed to respect and ensure respect for the laws in force. GROOM EPERNAY VTC reserves the right to interrupt any service on the spot, in the event that the customer becomes involved in behavior endangering the safety of the driver, the rented vehicle or other road users. The service will then be invoiced in full to the customer. Customers who are too intoxicated or insulting the driver will in no case be allowed to board the vehicles. The service will then be invoiced in full to the customer. The volume of luggage transported is proportional to the capacity of the vehicle. They remain during the entire service under the responsibility of the persons transported. Any modification of the journey by the customer or by his principal, may generate supplements which will be invoiced to him.

The service provided by the company GROOM EPERNAY VTC as regulated by articles L.231-1 to L.231-4 and R.231-1 to R.231-9 of the Tourism Code, consists of making available for the benefit of the customer of a vehicle, inseparably combined with the services of a driver. The following are thus included in the service: the vehicle made available to the customer; the provision of a driver speaking at least French; professional insurance for passengers transported for consideration, the kilometers traveled, vehicle maintenance, fuel and the duration determined when booking the service the provision on board of service vehicles (WIFI, bottles of water, refreshing wipes, phone chargers, touch pad) transportation of the client's luggage, within the limits of the vehicle's possibilities. the cost of tolls The following are not included in the Service: the cost of parking lots and more generally of all parking places; entrance fees to the sites (museums, theaters, castles, stadium or others); entrance fees to public places the driver's meals and accommodation costs for a trip over several days.

ARTICLE 4 – RATES

The tariffs established by telephone are given as an indication and can be modified according to the definitive service requested. Examples of rates:

-A race of up to 50 kilometers = € 2 incl.VAT / kilometer

-A race of at least 51 kilometers and up to 100 kilometers = 1.90 € incl.VAT / kilometer

-A race of at least 101 kilometers and up to 200 kilometers = 1.80 € incl.VAT / kilometer

-A race of at least 201 kilometers and up to 300 kilometers = 1.70 € incl.VAT / kilometer

-A race of at least 301 kilometers and up to 500 kilometers = 1.60 € incl.VAT / kilometer

-A race of at least 501 kilometers and more = 1.50 € incl.VAT / kilometer

-Price of the waiting time  concluded in the estimate =  40€ incl.VAT / hour.

-Night Rate: 7PM to 7AM, Sundays and holidays included for kilometers only.(exclude minimum rate) = normal rate/kilometer + 0.50€incl.VAT / kilometer.

-Minimum rate = 20€incl.VAT even if the race is less than 10 kilometers.

The quotes (durable support) are established for a period of one month from the date of publication. To confirm this price, it is recommended to send a reservation request or to confirm the quote by sending it back with the mention "good for agreement".

GROOM EPERNAY VTC will confirm all the details of this request and in particular the price of the service. Our prices are inclusive of VAT, and are expressed in Euros (€). The applicable VAT rate for transfers and transport is 10%. The applicable VAT rate for hourly deliveries is 20%. The transfer rate applies to direct travel, without stop, without stopover, from the place of pick-up to the place of arrival previously established in the contract. The rates are applicable for operations not exceeding 2 vehicles of the same category. Beyond that, GROOM EPERNAY VTC reserves the right to increase its prices according to the number of vehicles desired. The prices are understood by vehicle, whatever the number of people transported (up to 3 for the sedans and up to 7 for the minivans). For the provision, any hour started is due.

Any additional kilometer to the package established by the contract will be invoiced at € 2 incl.VAT  / km. Any additional hour to the package established by the contract will be billed at € 45 incl.VAT  / hour including tax.

For trips planned over several days, the following flat rates will be charged to the customer:

Meal = 30 € incl.VAT.

Hotel night + breakfast = 125 € incl.VAT. 

 

Our rates include:

-VAT

-The vehicle made available to the customer

-The provision of a driver speaking at least French

-Professional insurance for passengers transported for consideration

-The kilometers traveled

-Vehicle maintenance

-Fuel and the duration determined when booking the service transportation of the client's luggage, within the limits of the vehicle's possibilities

-The provision on board of service vehicles (WIFI, bottles of water, refreshing wipes, phone chargers, touch pad)

-The cost of tolls.

 

Our rates do not include:

-The cost of parking lots and more generally of all parking places

-Entrance fees to the sites (museums, theaters, castles, stadium or others)

-Entrance fees to public places

-The driver's meals and accommodation costs for a trip over several days.

ARTICLE 5 – PAYMENT

Our services are payable in cash, in euros, at the time of booking or on board the vehicle, when the customer is taken care of, except for our “Large Account” customers and partners for whom periodic invoicing is established. We accept payment by bank transfer (payment upon reservation), cash, bank card (Visa, Mastercard, American Express, etc.) and PayPal. Cheques are not accepted. For our “Large Account” customers and our partners, the services are payable in cash upon receipt of an invoice unless there is a specific contractual agreement. No discount is granted for payment on a date prior to the service. In all cases, the client signing the reservation is solely responsible for paying for the service in the event of user default. Any additional service, any exceeding of kilometer or duration, will be invoiced in accordance with the price indicated on the order form. Any hour started is due in full. For wedding or excursion packages, the reservation only becomes firm after payment of a non-refundable deposit equal to 30% of the amount of the service.

ARTICLE 6 – CANCELLATION

Any cancellation of reservation less than 24 hours before the start of the service will be considered due and invoiced to the customer. Beyond a waiting period of 15 minutes at the pick-up location, the service will be considered due and billed to the customer. In the absence of the client, the service will be considered due and invoiced.

ARTICLE 7 – LIMITATIONS OF LIABILITY

GROOM EPERNAY VTC cannot in any case be held responsible for delays on rail and air traffic. GROOM EPERNAY VTC cannot in any case be held responsible for delays due to road traffic beyond its control: road blocked, bridge prohibited to traffic, traffic jams, flooded road, demonstration, weather conditions, interventions of the police forces, firefighters or customs, etc ... (non-exhaustive list).

GROOM EPERNAY VTC can in no way be held responsible for delays directly resulting from an initial delay by the customer, or the need to make a journey, at the request of the customer, in a manifestly too short period. In case of immobilization of the vehicle due to a mechanical failure, an accident or damage (theft, damage),

GROOM EPERNAY VTC will endeavor to ensure the continuity of the route, either with one of its vehicles, or with a vehicle chartered to another company and undertakes to notify the client.

ARTICLE 8 - INSURANCE

GROOM EPERNAY VTC's liability is limited to the clauses of our insurance contract. Our vehicles are insured for the transport of people and our travelers for all bodily injury with our insurer. This insurance also covers professional civil liability, in accordance with French regulations in force, in application of article L. 3120-4 of the Transport Code. The ordering party will have any option to take out additional insurance at his expense covering cancellation costs, repatriation costs or baggage transported.

ARTICLE 9 – PERSONAL DATA 

GROOM EPERNAY VTC is committed to respecting the privacy of its customers. GROOM EPERNAY VTC undertakes to respect the confidentiality of personal data collected on its website in accordance with French Data Protection Act n ° 78-17 of January 6, 1978. As such, GROOM EPERNAY VTC undertakes not to disclose to third parties the information communicated by the customer on his website and to use it only for the processing of his reservation, and customer loyalty. The customer can exercise a right of access to his file and a right to rectify or delete information concerning him by sending his request to the Customer Service of GROOM EPERNAY VTC.

ARTICLE 10 – DISPUTES

Any complaint must be notified in writing and by registered letter to the attention of Customer Service, within a maximum period of 8 days. After this period, no claim will be successful. Subject to legal provisions, any dispute is, by express agreement, the exclusive competence of the Commercial Court of Reims (Marne).
